Gargasz, Ohio Stands Up! sue DeWine to stop Vax-a-Million lottery

Calling Ohio's Vax-a-Million program "bribery" and vaccines "poisonous" to children, attorney Robert Gargasz has filed suit against Ohio Gov. Mike DeWine and his budget and management director before the Ohio Supreme Court, seeking to halt the program and the use of taxpayer money to fund it. Gargasz filed the action against DeWine and Kimberly Murnieks, director of the state's Office of Budget and Management, on behalf of Ohio Stands Up! on Monday, seeking to prevent "serious public injury to Ohio's children and Ohio's treasury" by canceling the Vax-a-Million vaccine lottery. The writ of prohibition seeks to prevent DeWine and Murnieks "from committing violations of law and illegally spending" $5 million on the Vax-a-Million program. It also seeks to "prevent child abuse and criminal battery of children in Ohio by dangerous experimental and untested DNA altering poisonous mRNA shots." Ohio Stands Up! is "a taxpayer who will be harmed and who seeks to prevent the continued and further abuse of corporate power of the state and the loss of the public fund and treasury by misfeasance of the governor as he abuses the authority of his office and the state's treasury while all those around him are apparently asleep at the switch," Gargasz wrote. "Auditor, Attorney General, Inspector General, Treasurer are all failing to act and perform their respective jobs/duties as Governor DeWine has them miraculously somehow compromised or politically neutered." The judgments Gargasz seeks are "the only means available to prevent and stop (DeWine's) tyranny and plundering," he wrote, calling Vax-a-Million "nothing but a political bribery stunt and a further power play to destroy the finances of Ohio and its economy by (DeWine's) participation in the fraudulent globalist pandemic." Gargasz further claims DeWine has no authority to spend money on Vax-a-Million without legislative authority, that DeWine is violating the 1947 Nuremberg Code "by mandating vaccination of children with experimental and untested and unsafe mRNA vaccines that are harmful and dangerous and modify human DNA." Furthermore, DeWine is not a doctor but has "unconstitutionally ordered the use of medical devices 'masks' and the masking of citizens (despite his not being a medical doctor nor licensed to practice medicine) preventing healthy citizens from breathing freely and exhaling as God intended unobstructed." Gargasz further cited as evidence an affidavit from Dr. Scott Jensen, a Republican former Minnesota state legislator who wrote that "anyone under the age of 17 is at statistically zero risk of dying of COVID-19 infection." A DeWine spokesman declined to comment on Gargasz's lawsuit Tuesday. Gargasz's complaint about "poisonous" shots that alter human DNA is at odds with accepted science. The Centers for Disease Control and Prevention, in charge of public health in the United States, says mRNA vaccines will not give someone COVID-19 and do not affect or interact with DNA in any way. According to its website, "mRNA never enters the nucleus of the cell, which is where our DNA (genetic material) is kept." Additionally, "the cell breaks down and gets rid of the mRNA soon after it is finished using the instructions." Likewise, The Ohio State University's Wexner Medical Center, on its website, states: "The COVID-19 vaccine is safe and effective." According to Wexner, the COVID-19 vaccines contain messenger mRNA that enters human cells and "produces a protein to stimulate and immune response, similar to COVID-19." "Now if you encounter the real virus, your body will recognize COVID-19 and is trained to fight it," the hospital said on its website. Tomlinson in November, and Ohio Stands Up! are not the only parties seeking to get rid of the Vax-a-Million program. The Ohio Capital Journal reported May 22 that State Rep. Jena Powell, a Republican from Arcanum, "is drafting legislation that would prevent the state from administering any vaccine lottery program." Powell, who has been a critic of DeWine, masking and pandemic protections, represents portions of Darke and Miami counties in southwest Ohio — two of the least-vaccinated counties in the state, the Capital Journal reported. Gargasz and Ohio Stands Up! previously dropped their federal court case over the alleged "tyranny" of Ohio Department of Health orders on March 4, the Capital Journal reported.
