Phillips asks Ohio Supreme Court to reconsider rejecting voter fraud suit

ELYRIA — Attorney Gerald Phillips has asked the Ohio Supreme Court to reconsider a decision against his client, former Lorain City Councilman Dennis Flores, when it declined to force authorities to investigate voter fraud that allegedly took place more than five years ago. Earlier this month, the state's high court unanimously rejected Phillips and Flores' request to force the Lorain County Prosecutor's Office to conduct an investigation into alleged voter fraud during the 2015 Lorain City Council primary election. Prosecutor Dennis Will said he had done what was required of him at the time, passing the case along to the Lorain Police Department for investigation. Phillips now is asking justices to expand on their decision as they failed to list the reasons behind it. In a motion for reconsideration, Phillips wrote that he is "not a (mind) reader." "Surely, if the attorneys can spend countless hours and time presenting their arguments to the Court, then this Court must and should perform its constitutional duty and issue an opinion responding to such arguments," he wrote. An attorney for Will and Assistant Prosecutor Gerald Innes wrote in court documents that Phillips was only seeking attention for his Republican primary race for county commissioner. That issue was decided by voters on April 28, when Phillips lost to North Ridgeville City Councilwoman Michelle Hung, who now moves on to face incumbent Democrat Lori Kokoski in the November election. Phillips has since sued to overturn the election result.
